Terms and Conditions

This document sets forth the terms and conditions (“Terms”) under which patients may access and utilise the services (“Services”) provided by The Sydney Pain Clinic, located at 18 Roslyn Street POTTS POINT 2011, Sydney, New South Wales, Australia, operated and headed by Dr Chow Chow (“us,” “we,” “our,” or “the Clinic”).

  1. General Conditions: We reserve the right to refuse service to anyone for any reason at any time, in compliance with applicable laws. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. Unauthorised reproduction, duplication, reselling, or exploitation of any aspect of the Service is strictly prohibited without our express written consent.
  2. Accuracy, completeness, timeliness of information: We do not warrant or guarantee that the information made available on this site is not accurate, complete or current. The information is intended for general understanding and should not serve as the primary basis for healthcare decisions. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. Consultation with primary healthcare providers is strongly recommended. We disclaim liability for reliance on information provided on our site.
  3. Modification to the service and prices: Prices and Services are subject to change without prior notice. We reserve the right to modify or discontinue any service without liability. All initial consults are 30 minutes, and review consults are 15 minutes. Additional fees apply for extended consultations. If longer consultation is required, it should be done at the time of booking. The Sydney Pain Clinic reserves the right to charge additional consult fees, known as ‘long consult fees,’ incremented every 15 minutes.
  4. Cancellation policy: This policy outlines the terms and conditions governing the scheduling and cancellation of appointments at our medical facility. It serves to minimise disruptions caused by late cancellations and no-shows, thereby enabling optimal healthcare delivery to the community we serve. To further secure your commitment and minimise the frequency of no-shows and late cancellations, the clinic reserves the right to request a deposit at the time of booking. This deposit shall be refunded or deducted from the total consultation fee, provided that the appointment is attended as scheduled on the same day. The deposit shall be forfeited in the event of a no-show or a cancellation made less than 48 hours prior to the scheduled appointment time. We recognise that unforeseen circumstances may arise, compelling you to cancel a prearranged appointment. Should you find yourself in such a situation, we kindly request that you notify our office no less than 48 hours prior to the scheduled consultation. Doing so allows us the opportunity to reallocate your time slot to another patient who may be in need of urgent medical attention. Please be advised that our clinical services, particularly those provided by the consulting physician, are in high demand due to the pervasive incidence of chronic pain within the community. In the event that you cancel an appointment without providing a minimum of 48 hours’ notice, a cancellation fee amounting to 50% of the consultation cost will be levied. This applies uniformly to both initial consultations and subsequent review consultations. Your adherence to this stipulation is requisite for the maintenance of a harmonious practitioner-patient relationship and ensures fair service availability for all patients.
  5. Services: We reserve the right to limit the sales of our Services to any individual, jurisdiction, or geographic region. We may exercise this right on a case-by-case basis. The quality of products, services, or any other material is not warranted to meet your expectations. All descriptions of service pricing are subject to change at anytime without notice, at the sole discretion of us. The service include the aids of technology, including but not limited to, the use of electronic mail, online submission of personal information, use of audiovisual technology and telephony services, dictation and transcription services, transferring information to nominated healthcare providers via electronic means.
  6. Use of Personal Information: Your submission of personal information through the store is governed by our Privacy Policy, which complies with applicable Australian privacy laws.
  7. Intellectual property: The Service contains materials, such as software, text, graphics, images, audiovisual technology, and other material provided by or on behalf of the Sydney Pain Clinic (collectively referred to as the “Content”). Unauthorised use of the Content may violate copyright, trademark, and other intellectual property rights or laws. You have no rights in or to the Content, and you will not use the Content except as permitted under this Agreement and the functionality of the Service. No other use is permitted without prior written consent from us. You must retain all copyright and other proprietary or legal notices contained in the original Content. The Content may not be copied, modified, reproduced, or used for any public or commercial purpose without our express written consent. If you violate any part of this Agreement, your permission to access the Service automatically terminates and you must immediately destroy any copies you have made of the Service. The trademarks, service marks, and logos of the Sydney Pain Clinic and Dr Chow Chow used and displayed on the Website are registered and unregistered trademarks or service marks of Dr Chow Chow. Use of the Trademarks as part of a link to or from any website is prohibited unless establishment of such a link is approved in advance by us in writing.  All goodwill generated from the use of Dr Chow Chow and the Sydney Pain Clinic Trademarks inures to our benefit.  Elements of the Services are protected by trade dress, trademark, unfair competition, and other state and federal laws and may not be copied or imitated in whole or in part, by any means, including, but not limited to, the use of framing or mirrors. None of the Content may be retransmitted without our express, written consent for each and every instance. You agree to abide by all copyright laws and intellectual property protections as outlined in this Agreement.
  8. Guidelines:  By accessing the Services, you hereby agree to comply with the following guidelines:
    • You will not use the Service for any unlawful purpose;
    • You will not access or use the Service to collect any market research for a competing businesses;
    • You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
    • You will not exert inappropriate behaviour towards the staff and doctors working in the Sydney Pain Clinic
    • If you opt to use telemedicine service, you MUST obtain a referral with written request for telehealth from your nominated doctor, who has completed an in person consultation, in the last 12 months
    • Our clinic advocates an opioid reduction strategy and does NOT endorse the long-term use of opioids. In rare circumstances requiring short-term use of opioids (less than 12 weeks), a detailed strategy for reduction must be exercised, adhering strictly to a single prescriber and single dispenser model. No ‘red flags’ should be identified in the NSW SafeScript database. No opioid will be prescribed from the clinic.
    • We reserve the right, in our sole and absolute discretion, to deny you (or any device) access to the Service, or any portion thereof, without notice.
  9. Feedback: We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Website and our services .  Any feedback should be provided through authorised channels. Any feedback you provide may be used in the development, production, and marketing of products and services without compensation or attribution to you, subject to relevant intellectual property laws.
  10. Indemnification:   You will indemnify, defend, and hold the Sydney Pain Clinic and its shareholders, members, officers, directors, employees, agents, and representatives harmless from and against any and all damages, liabilities, losses, costs, and expenses, including reasonable legal fees incurred by any the Sydney Pain Clinic  Indemnitee in connection with a third-party claim, action, or proceeding (each, a “Claim”) arising from (i) your breach of this Agreement; (ii) your misuse of the Service, and/or the Content; and/or (iii) your violation of any third-party rights, including without limitation any copyright, trademark, property, publicity, or privacy right; providedhowever, that the foregoing obligations shall be subject to our: (i) promptly notifying you of the Claim; (ii) providing you, at your expense, with reasonable cooperation in the defence of the Claim; and (iii) providing you with sole control over the defence and negotiations for a settlement or compromise. However, the foregoing obligations shall be conditioned upon our promptly notifying you of the Claim in writing and cooperating with you at your expense.
  11. Prohibited use: In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site, the service, and the content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to spam, phish, pharm, pretext, spider, crawl, or scrape; (h) for any obscene or immoral purpose; or (i) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service for violating any of the prohibited uses, in compliance with relevant laws.
  12. Termination: The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our service. If, in our sole judgment, you fail to comply with any term of this Agreement, we may terminate this Agreement without notice, in accordance with the law. Obligations and liabilities incurred prior to termination survive the termination.
  13. Entire Agreement: The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
  14. Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New South Wales, Australia.
  15. Changes to term of services: You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of the Service constitutes acceptance of these changes, as permitted by law.
